What are hot topics in the legal profession in Iowa?

If you are wondering what is happening in the professional legal community in Iowa right now in terms of the profession, practice, and impact, below are some of the topics that most commonly come up in meetings and conversations: 

- Indigent defense: This is the right for criminal defendants who are living in poverty to have legal counsel provided to them. The Sixth Amendment of the U.S. Constitution guarantees this right. In Iowa, as with many other states, there are not enough attorneys contracted through the government who can provide legal help to individuals charged with a crime who cannot afford a lawyer. The State Public Defenders Office is funded through government and employees defense attorneys for these types of cases, however, there are too many cases for these attorneys to handle. The state also pays contract attorneys who are in private practice but contract with the state to take on indigent defense cases. However, there are not enough attorneys contracting with the state to meet the needs of indigent defendants. 

- Judicial pay: The Iowa Judicial Branch and Iowa State Bar Association support an increase in salaries paid to judges. Chief Justice Susan Christensen has spoken about this publicly in her annual Condition of the Judiciary speech. 

- Rural practice: The majority of attorneys licensed to practice in Iowa are located in metro areas, leaving communities and people who live in rural areas of the state without access to a nearby attorney. There are programs aimed at increasing the presence of attorneys in rural areas. 

- AI and technology: The pandemic put the legal profession and industry on a fast track to adopting new technology. There are benefits and drawbacks to AI in the legal profession. 

- Diversity, equity, and inclusion: There are initiatives and collaboration across the state to enhance DEI in the legal profession and make it reflective of the population served. 

- Attracting and maintaining legal talent in the state: There is much collaboration in the legal community including law schools on how to attract young lawyers to the state of Iowa and then support the success of their practices to keep them in the state. 

- Well-being: The legal profession can be highly stressful with deadlines, client relations, application of law, and more. That is why there is such a high rate of alcoholism and addiction in the profession. Lawyer well-being is a constant topic of conversation involving what resources are out there for legal professionals, confidentiality, and support. 

- Ethics: Lawyers are bound to ethical responsibilities when they take their oath and enter the bar. Case conflicts, trust account management, client confidentiality and more are consistently discussed.
